ASNE has joined amici briefs in two press-freedom cases.

  • One case will decide whether a broadcast reporter’s outtakes can be subpoenaed. "While this case deals with outtakes of a videotaped interview, many recognize the parallel between these outakes and a print reporter’s notes that are left out of the final publication," said Kevin M. Goldberg, an associate of ASNE legal counsel Richard M. Schmidt Jr. The case focuses on Frank Smith who contacted a New Orleans television station, stating that he had information about a warehouse fire suspected as arson. He was interviewed on camera by the station and by the superintendent of the city’s fire department. The case (United States vs. Frank Smith) is being heard by the U.S. Court of Appeals for the 5th Circuit.
  • The other case involves a Superior Court of California decision to close a libel trial involving actor Clint Eastwood and Sondra Locke.
